Welcome to Kashmir Online Lab. By accessing our website, mobile application, or availing of our diagnostic services, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. General Provisions

  • Acceptance: By using our platform, you signify your acceptance of these terms. If you do not agree to these terms, please do not use our services.

  • Modifications: We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on the website.

2. Services Provided

  • Diagnostic Testing: Kashmir Online Lab provides pathology and diagnostic testing services. We act as a service provider collecting samples and generating reports based on scientific analysis.

  • Home Collection: We offer home sample collection services in specific operational areas. While we strive to be punctual, timings are subject to traffic, weather conditions, and staff availability.

3. Booking and Payments

  • Accuracy: You agree to provide accurate and complete information (Name, Age, Gender, Contact Details) when booking a test. Incorrect information may lead to errors in your report, for which we are not liable.

  • Pricing: Prices for tests are listed on our website and are subject to change without notice. The price applicable at the time of booking will be charged.

  • Payment: Payments can be made online or via Cash on Collection (if applicable). Online payments are processed through secure third-party gateways.

4. Sample Collection and Processing

  • Patient Preparation: It is your responsibility to follow specific preparation instructions (e.g., 10-12 hours fasting) for tests. Failure to do so may result in inaccurate results or the need for a re-test at your expense.

  • Right to Refuse: Our phlebotomists reserve the right to refuse sample collection if the environment is unsafe or if the patient is uncooperative.

  • Re-sampling: In rare cases (e.g., sample hemolysis, clotting, or insufficient quantity), a second sample may be required. We will collect this at no extra cost, but we are not liable for the resulting delay in reporting.

5. Reporting and Results

  • Timeline: Turnaround times mentioned are estimates. Delays may occur due to technical issues, quality control checks, or unforeseen circumstances.

  • Not a Diagnosis: Our lab reports provide clinical data based on the sample provided. A lab report is not a medical diagnosis. You must consult a qualified doctor to interpret the results and determine a course of treatment.

  • Delivery: Reports will be delivered digitally via email/WhatsApp/portal. Hard copies may be available upon request (additional charges or store pickup may apply).

6. Cancellation and Refund Policy

  • Cancellation by User: You may cancel your booking up to [Insert Time, e.g., 2 hours] before the scheduled collection time for a full refund.

  • Late Cancellation: Cancellations made after the phlebotomist has been dispatched may incur a visit charge.

  • Refunds: Refunds for prepaid bookings will be processed within [Insert Days, e.g., 5-7 business days] to the original payment method. No refunds are possible once the sample has been processed.

7. Limitation of Liability

  • Accuracy: While we adhere to strict quality control standards, diagnostic testing is subject to a small margin of error. Kashmir Online Lab is not liable for false positives/negatives caused by biological factors or sample degradation during transport, provided standard protocols were followed.

  • Indirect Damages: We are not liable for any indirect, incidental, or consequential damages (including mental distress or loss of income) arising from the use of our services or delays in reporting.

8. User Conduct

You agree not to:

  • Use the website for any unlawful purpose.

  • Upload false or misleading medical history.

  • Harass or mistreat our field staff (phlebotomists).

9. Force Majeure

We are not liable for any failure to perform our obligations where such failure is due to events beyond our control, including but not limited to severe weather (snow/floods), curfews, internet outages, or strikes.

10. Jurisdiction

These Terms and Conditions are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Srinagar, Kashmir.
